According to court documents, Jamie Foxx is charged with sexually abusing a lady at a restaurant in New York.
According to the woman’s complaint, which PEOPLE was able to obtain and which was filed in New York Supreme Court on Wednesday, the event happened in August 2015 at Catch NYC.
The 55-year-old Foxx, whose real name is Eric Marlon Bishop, was seen sitting “one table away having drinks” with co-founder of Catch Hospitality Group Mark Birnbaum, according to the alleged victim, Jane Doe, who claimed to have entered the establishment.
Doe claimed that she and a friend went to Foxx’s table at around one in the morning to request a photo with the Academy Award winner. He said, “Sure baby, anything for you,” according to her, and he then took “several photographs.”
She asserts “Wow, you have that super model body,” “You smell so good,” and “You look like Nickie,” said the Burial actor to her. “Who’s Nickie?” she inquired. Foxx answered, “Gabrielle Union.” Then, she claimed, he took hold of her arm and dragged her to the rear portion of the rooftop.
After they had reached a private area, Foxx allegedly “placed both of his hands on her waist, moved them under her ‘crop top,’ and began rubbing her breasts,” according to the court document.
A security guard was visible to her as she tried to move away from him, she added, “some distance away who saw what was happening but walked further away.” Foxx allegedly placed his hands inside Doe’s pants and inserted his fingers into her anus and vagina.
The woman went on to say that Foxx stopped and approached the security guard when her companion came outside at this same time and seen the other woman.
She was “injured [and] was rendered sick, sore, lame, and disabled; [and] was caused to undergo medical treatment and advice,” according to Doe, as a result of his acts.
The injuries and emotional distress Doe sustained as a result of the sexual assault, abuse, assault, and battery meant that she “was unable to pursue her usual and regular activities; was caused to undergo great conscious pain and suffering, continues to undergo such, and will be affected by the injuries and emotional distress she incurred forever.”
Foxx is described as “a well-known celebrity [who] committed the heinous acts” in the documents. According to Doe, she “has suffered and still suffers from emotional and physical harm, anxiety, distress, embarrassment, and economic harm.”
She is requesting punitive damages in a sum that surpasses the jurisdiction of all subordinate courts, together with damages for economic loss and pain and suffering.
When PEOPLE contacted Jamie Foxx’s representatives for comment, they did not receive a response right away.
The deadline for filing complaints under the Adult Survivors Act of New York is this Wednesday.
